Welcome to Caseway. These Terms of Use (“Terms”) govern your access to and use of the Caseway website and services (collectively, the “Service”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. About Caseway
Caseway is owned and operated by CaseWay LLC, a Wyoming limited liability company (“Caseway”, “we”, “us”). Caseway is an online directory and discovery platform that helps members of the public find independent attorneys. Caseway is not a law firm, does not practice law, and does not provide legal advice, legal representation, or referrals. We do not recommend or endorse any particular attorney.
2. No Attorney-Client Relationship
Using the Service does not create an attorney-client relationship between you and Caseway, or between you and any attorney listed on the Service. An attorney-client relationship is formed only when you and an attorney expressly agree to it, separately from the Service.
3. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. By using the Service, you represent and warrant that you meet these requirements.
4. Attorney Listings
Information about attorneys, including their practice areas, locations, languages, fees, and contact details, is provided by the attorneys themselves or compiled from third-party sources. Caseway does not independently verify this information and is not responsible for its accuracy, completeness, or timeliness. You are responsible for confirming an attorney’s licensing, credentials, and good standing with the relevant state bar before retaining them.
5. Attorney Responsibilities and Accuracy of Listings
If you are an attorney who submits a listing or application to be featured on Caseway (an “Attorney”), you are solely responsible for the accuracy, completeness, and truthfulness of all information you provide, including your name, firm, title, credentials, licensing, bar admissions, jurisdictions, practice areas, years of experience, fees, and any other statements or representations in your listing. By submitting a listing, you represent and warrant that:
- You are a licensed attorney in good standing in every jurisdiction your listing identifies, and you will promptly update or remove your listing if that ceases to be true;
- All statements and representations in your listing are true, accurate, and not misleading at the time of submission and for as long as the listing remains active; and
- You will not make any false, deceptive, fraudulent, or unauthorized representation about your identity, qualifications, results, or services.
You are solely and fully responsible and liable for any false, inaccurate, or misleading representation you make in your listing or application. Because Caseway does not verify attorney-submitted information, you agree to defend, indemnify, and hold Caseway harmless from any claim, demand, loss, liability, or expense (including reasonable attorneys’ fees) arising out of or relating to any misrepresentation you make or any inaccuracy in your listing. Caseway may edit, suspend, or remove any listing at any time, with or without notice, including for suspected inaccuracy, misrepresentation, or violation of these Terms.
6. Paid Listings, Payments, and Billing
Attorney listings are offered on a paid subscription basis. The price that applies to you is shown before you submit, and you are billed at the time you submit your listing. Subscriptions renew automatically each billing period until you cancel; you may cancel at any time (see our Refund & Cancellation Policy).
Payments for Caseway listings are collected and processed by Indicium Markets Inc. on behalf of CaseWay LLC, using a third-party payment processor (Stripe). By purchasing a paid listing, you authorize Indicium Markets Inc. to charge your payment method for the applicable fees, including recurring subscription fees, until you cancel. Indicium Markets Inc. is the merchant of record and may appear as such on your billing statements and receipts.
7. Acceptable Use
You agree not to:
- Use the Service for any unlawful or fraudulent purpose;
- Submit false, misleading, or unauthorized information, including in any attorney listing;
- Scrape, harvest, or collect data from the Service without our written permission;
- Interfere with or disrupt the integrity or performance of the Service.
8. Intellectual Property
The Service, including its design, text, graphics, and logos, is owned by Caseway or its licensors and is protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent.
9. Third-Party Services and Links
The Service may contain links to third-party websites and tools (for example, mapping or scheduling providers). We are not responsible for the content, policies, or practices of any third party. Your use of third-party services is governed by their terms.
10. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Caseway does not warrant that the Service will be uninterrupted, secure, or error-free, or that any information on the Service is accurate.
11. Limitation of Liability
To the fullest extent permitted by law, Caseway and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising out of or related to your use of the Service or your dealings with any attorney found through the Service.
12. Indemnification
You agree to indemnify and hold harmless Caseway from any claims, damages, liabilities, and expenses arising out of your use of the Service or your violation of these Terms.
13. Changes to These Terms
We may update these Terms from time to time. Changes are effective when posted on this page with an updated “Last updated” date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
14. Governing Law
These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-law principles.
